AVAILABILITY OF GOODS<\/strong><\/p>\n

  1. All goods advertised on this site are subject to availability. If an item that\u00a0you wish to order is unavailable, we shall inform you by telephone or e-mail.<\/li>\n
  2. We shall not charge you for goods that we cannot supply for any reason. \u00a0However we will not be responsible for any losses or damage that may\u00a0occur if we fail to supply goods.<\/li>\n
  3. We have made every effort to display all the goods on the website as\u00a0accurately and fairly as possible.<\/li>\n
  4. We will meet our responsibilities under this contract within a reasonable\u00a0time unless it is impossible to do so because of circumstances beyond\u00a0our reasonable control; in particular we will not be responsible for delays\u00a0caused by our suppliers or outside contractors.<\/li>\n<\/ol>\n

    1. You confirm that you are aged over 18 years of age and are legally\u00a0(subject to your local jurisdiction) able to purchase prescription\u00a0spectacles\u00a0from PROGEAR VISIONLAB INC.<\/li>\n
    2. You confirm that you are not registered blind or partially sighted.<\/li>\n
    3. You agree that you will provide any details reasonably requested by \u00a0PROGEAR VISIONLAB INC. LTD. to confirm that you are legally able to\u00a0purchase prescription spectacles.<\/li>\n
    4. You agree to make purchases on the PROGEAR VISIONLAB INC.\u00a0LTD. (progearvisionlab.com) website using your correct name, address,\u00a0date of birth and any other details requested.<\/li>\n
    5. All prescriptions that you supply to us must have been given to you by a\u00a0registered medical practitioner, optometrist or registered optician\u00a0following a sight test by him or her within the last 12 months.<\/li>\n
    6. Unless specifically agreed by phone or email, we will only supply\u00a0spectacles with lenses of a spherical power between +4.00 and -6.00(diopters) and a cylindrical power between +0.00 and -4.00(diopters). We may also reject certain prescriptions with high\u00a0spherical and cylindrical power combination, subject to final\u00a0determination of our in-house master optician or laboratory technical\u00a0officer.<\/li>\n
    7. All products and prices displayed on the website are single (distance)\u00a0vision. If you require varifocals\/bifocals please contact our customer\u00a0service (cu*************<\/span>@**************<\/span>ab.com<\/span>).<\/li>\n
    8. When ordering from us, we shall rely upon the prescription provided by\u00a0you. You are responsible for entering the prescription information and\u00a0PD (pupillary distance) measurement as requested, or upload your\u00a0latest prescription onto our website. Our in-house master optician or\u00a0laboratory technical officer will verify your prescription with their best\u00a0knowledge. However, no liability is accepted by PROGEAR VISIONLAB\u00a0INC. LTD. for any mistake made by you in providing your prescription or\u00a0PD measurement.<\/li>\n
    9. Prices displayed on our website are correct at time of display. We\u00a0reserve the right to alter prices from time to time without notice. \u00a0However, once your order has been accepted, we will not change the\u00a0price that applies without your agreement.<\/li>\n
    10. For prescription eyewear, all prices shown are fully inclusive of two\u00a0prescription lenses, optical adaptors (if required) and glazing.<\/li>\n
    11. All prices displayed are exclusive of any import duty or tax that may\u00a0arise on importing the purchase to your country. You are responsible to\u00a0settle this import duty or tax with the local courier service provider before\u00a0they will deliver the purchase to your address.<\/li>\n
    12. Prices are fully inclusive of packaging and delivery within Hong Kong\u00a0and China. There will be a maximum shipping charge of USD50 per\u00a0frame order for addresses outside of Hong Kong and China.<\/li>\n<\/ol>\n

      PAYMENT INFORMATION<\/strong><\/p>\n

      1. We accept payment by Visa\/Mastercard\/Discover\/AmericanExpress and\u00a0PayPal.<\/li>\n
      2. All credit and charge card payments are subject to validation and\u00a0authorization by the card issuer. If your card issuer refuses to authorize\u00a0payment, we will not be liable for any non-delivery or delay.<\/li>\n
      3. Transactions are processed in Hong Kong Dollar. All other currencies\u00a0displayed online are given as a guide, and may be subject to variation.<\/li>\n
      4. All payment must be made in full before goods are dispatched. Payment\u00a0is processed at the time of order.<\/li>\n<\/ol>\n

        ORDER ACCEPTANCE<\/strong><\/p>\n

        We will send you an order acknowledgement email detailing the products you\u00a0have ordered. This is not an order confirmation or order acceptance from\u00a0PROGEAR VISIONLAB INC. LTD. As your order is shipped from our\u00a0warehouse we will send you a confirmation email.<\/p>\n

        Order acceptance and the completion of the contract between you and us will\u00a0take place on the dispatch to you of the products ordered unless we have\u00a0notified you that we do not accept your order, or you have cancelled it in\u00a0accordance with the instructions below.<\/p>\n

        Non acceptance of an order may be a result of one of the following:<\/p>\n

        1. The product you ordered being unavailable from stock<\/li>\n
        2. Our inability to obtain authorization for your payment<\/li>\n
        3. The identification of a pricing or product description error<\/li>\n
        4. Your prescription is determined unachievable by our in-house master\u00a0optician or laboratory technical service.<\/li>\n
        5. You do not meet the eligibility to order criteria as set out in the rest of\u00a0this document.<\/li>\n<\/ol>\n

          DELIVERY OF GOODS<\/strong><\/p>\n

            \n
          1. Delivery will be by courier, mainly via UPS, FedEx, SF-Express or other\u00a0major courier services in your country.<\/li>\n
          2. All items will be delivered to the address specified by the customer on\u00a0the order form.<\/li>\n
          3. The finished spectacles with your personalized prescription are shipped\u00a0to you with 2 prescriptions for review: 1) your biological Rx prescribed\u00a0by your doctor, optometrist or certified optician, which you provided to\u00a0us; 2) the Rx of your glasses as it will read on a lensometer (lens power\u00a0measuring machine). Please read \u201cAdvanced Sports Vision\u00a0Technology\u201d on our website to understand \u201cpower compensation\u201d.<\/li>\n
          4. Upon delivery of goods you should carefully inspect them. If any of the\u00a0goods are damaged or lost, please contact us immediately to inform us\u00a0of the problem and do not use the goods.<\/li>\n
          5. All items will be delivered as quickly as possible and within 28 days. \u00a0However we cannot guarantee that goods will be delivered by the\u00a0estimated delivery date. You agree that we shall not be liable to you for\u00a0any losses, damages or charges incurred by you because of the late\u00a0delivery of goods.<\/li>\n
          6. You should notify us immediately if you have not received your goods\u00a0within 21 days.<\/li>\n
          7. When you have received the goods at the specified address, the risk of\u00a0damage to the goods is passed to you.<\/li>\n<\/ol>\n

            RETURNING GOODS<\/strong><\/p>\n

            1. It is our aim to ensure that you are completely satisfied with the goods\u00a0that you receive from us. Nonetheless, we do offer customers a 7 days\u00a0cooling off period. Therefore, for whatever reason, if you are not\u00a0completely satisfied with the goods that you have purchased you have\u00a0the right to a full refund, alteration or replacement. This cancellation right\u00a0starts the day the contract is concluded and lasts until 7 days after\u00a0receipt (receipt acknowledgement from courier service).<\/li>\n
            2. The above mentioned cancellation right excludes goods made to\u00a0customers specifications or goods that are personalized, such as\u00a0prescription orders. We will refund the value of the frame, providing that\u00a0it is in original condition and complete with case, cleaning cloth and\u00a0packaging. Unfortunately we cannot refund the value of the lens made\u00a0to your prescription.<\/li>\n
            3. Upon receiving your request to return, we will email you Return\u00a0Authorization Form to fill out. \u00a0Please return your purchase with this\u00a0Form and be responsible for your own shipping cost. \u00a0We recommend\u00a0using courier with tracking service or registered post service and retain\u00a0your receipt for proof of shipment and keep this receipt until your return\u00a0has been processed. \u00a0We regret that we cannot be held responsible for\u00a0anything lost or damaged in transit.<\/li>\n
            4. Lens scratch is considered to be wear and tear, and so is not covered by\u00a0manufacturer’s warranties. As such, returns for ‘lens scratch’ will only be\u00a0accepted upon receipt of the order, not once the product has been used.<\/li>\n
            5. Lens fogging is a natural reaction in certain conditions. \u00a0Returns will not\u00a0be accepted for ‘lens fogging’, apart from in exceptional circumstances.<\/li>\n
            6. Prescription\/Optical inserts for ski goggles or biking glasses are not\u00a0coated with Anti-fog coatings, unless specified, before dispatch. They\u00a0are, however, liable to ‘fogging’ because of the extreme conditions of\u00a0use. \u00a0Therefore, continued application of anti-fog cleaner is required, and\u00a0refunds cannot be issued after use on grounds of ‘fogging’.<\/li>\n<\/ol>\n

              LIABILITY<\/strong><\/p>\n

              1. Goods purchased from our website are subject to the law of Hong Kong\u00a0Special Administration Region.<\/li>\n
              2. None of the conditions set out in these terms and conditions shall affect\u00a0your statutory rights as a consumer.<\/li>\n
              3. Individual goods may be the subject of additional guarantees or\u00a0warranties given by their manufacturers to you.<\/li>\n
              4. We shall not accept any liability for any ordering errors made by you\u00a0when submitting your order. Please ensure that all details are correct\u00a0before submitting your order.<\/li>\n
              5. We do not accept responsibility and will not be liable for any damage to\u00a0the goods caused by you.<\/li>\n
              6. We shall not be liable to any person for any damage or loss that may\u00a0arise from the use of any goods advertised on our website.<\/li>\n<\/ol>\n
